Immigration Laws to the US
Different methods to immigrate to US:
First and foremost thing to become a U.S citizen is to obtain a Visa to enter the United States to reside there permanently. There are four general methods to obtain a green card for U.S. These are:
Green Card through Family:
A person is eligible to become a permanent resident of U.S through family members. The U. S government has given permission to U.S citizens and permanent residents to file for petitions for their (immediate) relatives to live permanently in the U.S.
The Immediate relatives are:
Spouse of a U.S citizen, unmarried and minor children (below 21 years) of a U.S citizen, the parents and step parents of a U.S citizen who is above 21 years, step child of a U.S citizen (the relationship must be created before the child was 18 years).
A person can also apply in one of the family based preference categories if he/she bears the necessary relationship with the U.S citizen or permanent residents.
In this case Unmarried adult son and daughters of the U.S citizens are given first preference, Spouses and Unmarried children of a permanent resident get the second preference. Married children along with their spouses and children of a U.S citizen gets the third preference. Fourth preference is given to adult siblings of a U. S citizen along with their spouses and children.
The petition needs to be filed via form I-130. Once the petition is approved the concerned person has to undergo some process including medical examination, police clearance, and all other documentary requirements.
Immigration based on employment:
A person can seek to immigrate based on employment, provided he/she falls under the preference category. A person get a first preference if he is a Priority worker having exceptional skill in the field of science, arts, education, Business, athletics, research to apply for green card. A person having advanced educational degree, professional holding baccalaureate degree, skill workers having experience and unskilled worker who are in short of supply also are eligible for a green card.
Persons who can generate employment through investment and special worker working for religious groups, current and former U.S Government employees also can obtain green card based on employment.
The prospective employee must have their U.S prospective employer file petition form I-140.
Green Card for a Refugee and Asylee:
A person who is a refugee must apply for a green card 1 year after the person has been admitted to the U.S as refugee. Similarly if a person is an asylee must apply for a green card 1 year after being granted asylum.
To apply green card for a refugee and asylee one needs to file Form I-485.
