Investment Laws in China:

The Chinese market is one of the most appealing markets for domestic as well as foreign investors. A basic understanding of Investment laws in China is mandatory for companies investing in the fastest rowing and potentially huge market. The door of China for foreign investors has been opened not long back thus the rules and regulation regarding the investment are quite vary from that of the matured economies. The Chinese Government even though had strict norms earlier but it continuously improved with research and examinations to that it can be compatible with norms of World Trade Organisation (WTO). This lead to the amendments of the Investment Laws in the year 2000 and since then it is continuously improving for attracting foreign investment. After the year 2000 foreign Invested Enterprises are allowed to use both foreign and domestic resources now, earlier Wholly Foreign Owned Enterprises required to export 70% of their total production, the rule has been diluted now.  Exemption is Import duty and business tax has also been granted in certain cases. So it is evident that China will continue to amend its laws to comply with requirements of WTO.

Copyright Law in China: The copyright law was enacted, in accordance with the constitutions for protecting the right of the authors in their works in the field of literature, arts and science. The law formed encourages creation which in turn contributes to the social and spiritual civilization of China. It also promotes socialist culture and science in China.
The copyright law is governed by the Copyright Law of the People’s Republic of China (PRC). The law was enacted in the year 1990 and implemented in 1991. The law was modified in the year 2002.
The rule for copyright varies for domestic work and work done by foreigners. The authors enjoy the copyright till 50 years after death of the author. The rule is slightly different for cinematographic and photographic works. These works enjoys copyright for 50 years after the first publication of the works. As per the Regulations on Implementation of International Copyright Treaties (1992) foreign copyright holders also can protect their interest in PRC.
Prior to the year 1991 computer software were not treated as a kind of literary work under the Copyright law, but after May 1991 with the intervention of the Berne Convention State council passed Computer Software Protection Rules. The copyright registration for computer software includes process like sharing some detailed information including the Software Source Code which the companies are apprehensive of sharing.
